* KEEP YOUR MOUTH SHUT!!!!!!!!!!!!!!!!!! You have Miranda rights for a reason. Anything that you "blurt out" to the police can be used against you.
* If you have interaction with the police, be polite and cooperative. They have the power and confronting the police or being verbally abusive will never work in your favor.
* If you are stopped for a DUI, politely refuse all road-side DUI tests. These tests are virtually impossible to pass and are designed to provide the police with additional probable cause to arrest you. Your refusal to take these tests is inadmissible in court. If you are transported to the police station, there are important factors to consider in deciding whether or not to submit to a breathalyzer test. Only you know how much alcohol you have consumed. This is an important factor in deciding whether or not to take the test. If you refuse the test, your license will be suspended for 270 days. But also keep in mind that they need a test result of .08 or higher to convict you of Driving Under the Influence. While you could still be convicted of Driving While Impaired, the possible penalties are 1 year of incarceration versus 60 days.
* Never consent to a search.
* If you are incarcerated, do not discuss your case with anyone but your attorney. Jails calls are recorded and listened to by the State's Attorneys Office routinely.
